Judicial priorities
In his April 14 column on the Supreme Court’s replacement for Justice Stevens (“Saving a Court seat for those who need it most”), Adam Yoffie wants us to believe it’s “dead wrong” to ignore ethnicity and left-wing notions of “diversity” in deciding who should get life tenure on the nation’s highest court.
Our Torah, in teaching us to neither favor the poor nor coddle the wealthy, is a teaching of moral competence. The notion that a sound judicial temperament is less important on the bench than (for example) whether a judge likes abortion is a notion born of something other than Judaic or Constitutional norms.
